In the near future, I plan to reintroduce legislation to enable local municipalities a greater degree of flexibility and cost savings when entering into intergovernmental agreements. Under current law, in order to enter into an Intergovernmental Cooperation Agreement, all municipalities involved must go through the formality of enacting an ordinance detailing the specifics of the agreement. The formal enactment of an ordinance requires the publication of a legal notice and the entry of the new ordinance into the ordinance book, both of which are costly and time-consuming endeavors for municipalities. The focal bill of this package is former HB 479, which amends the Pennsylvania Intergovernmental Cooperation Law (53 Pa. C.S.A. § 2301) by permitting a municipality to adopt a resolution instead of enacting an ordinance, unless specifically required by any other state law. The remaining portion of the package includes a bill to amend the Second Class Township Code and a bill to amend Title 11 (Cities), both making technical changes to allow these municipalities to take advantage of HB 479 of 2017. After numerous discussions with varying groups and colleagues, I have also included a provision to specify that a municipality must enact an ordinance if a council of governments, consortium or a similar entity is created. These bills were unanimously passed by the House last session and the PA State Association of Boroughs, PA State Association of Township Commissioners, PA Municipal Authorities Association, and the PA Municipal League were all in support of this bill package. I believe this legislation will save your municipalities both time and money, while also simplifying the process for aid and cooperation between local governments.
