Subject: Co-sponsorship: Local Radar (HB1272 of 2013)
 

At the request of local law enforcement in my district, I plan to re-introduce legislation that would amend Title 75 by “removing the prohibition against municipal police using radar to enforce the maximum speed laws”. House Bill 1272 of 2013 would have amended Title 75, Section 3368 (D), by removing the words “only by members of the Pennsylvania State Police” and adding the words “by any police officer”. This change would allow any police officer, with the appropriate certification, to utilize radar or LIDAR, to detect the speed of any vehicle.

Currently all fines shall be payable to the Commonwealth, for credit to Motor License Fund (Title 42, Section 3571 (b) (2) (i)), with one-half of the revenue to be paid to municipalities who have a population of not more than 3,000 or provide at least 40 hours per week of local police services (Title 42, Section 3571 (A)). Also Title 42 section 3571 (b) (3) which deals with prosecution as the result of local police action stating where one half goes to Motor License Fund will remain unchanged.

Under my proposed legislation, no sections of current law dealing with where the fines are applied will be changed.
