Subject: | Amending the Child Labor Act to Require Background Checks |
In the near future, I intend to introduce legislation that would amend the state Child Labor Act (Act 151 of 2012) to require a background check prior to the commencement of employment or volunteer service on the set of a performance where a minor is employed. The Child Labor Act, signed into law in 2012, rewrote the statute governing child labor to make it as consistent as possible with federal law, and to modernize provisions regulating child actors and performers. Significant measures were taken to ensure the overall health, safety and welfare of minors through measures such as, prohibiting employment or work in certain establishments and occupations; restricting hours of labor; regulating certain conditions of employment; and requiring employment certificates (general or vacation), for minors under the age of 18. My proposal would amend Section 5 of the Act, to require an individual to submit to a background check prior to the commencement of employment or volunteer service. The requirements in my proposal would emulate those found in Act 15 of 2015, adding additional measures to protect the children of Pennsylvania.
