MEMORANDUM

Posted: November 19, 2021 03:07 PM
From: Representative Parke Wentling
To: All House members
Subject: Repeal of Frozen Dessert Law

In the near future, I plan to introduce legislation that will repeal the Frozen Dessert Law, Act 215 of 1965. This legislation would do away with an outdated and archaic law that is no longer necessary, as other existing statutes and regulations remain in effect that assure the safety of frozen desserts.

Currently, the Frozen Dessert Law places burdensome requirements on businesses to perform monthly testing of frozen desserts. The testing parameters placed upon businesses under the Frozen Dessert Law are unnecessary and duplicative as testing is already required and carried out under the extensive Food Code regulations that the PA Department of Agriculture (PDA) follows in order to protect public safety.
Repealing this out of date law would support our business owners by doing away with costly and redundant bureaucratic processes, while still maintaining the food safety integrity of frozen desserts and the safety of our constituents.

I respectfully ask for your support on this important piece of legislation.

Sincerely,

Parke Wentling
