MEMORANDUM

Posted: March 11, 2019 10:58 AM
From: Senator Scott Martin
To: All Senate members
Subject: Protecting Student Sexual Assault Victims

In the near future, I intend to introduce legislation that will require a student who is convicted or adjudicated delinquent of sexual assault to be expelled at the victim’s request, if they are enrolled in the same K-12 school district.

Recently, I became aware of a young woman who was assaulted at a community event by her classmate. The assailant was charged and adjudicated for the crime, but when he returned, the victim had to attend school with her rapist on a daily basis. She relived her nightmare nearly every day and seriously considered moving to another district.

This legislation would ensure that no student victim in Pennsylvania would have to go to school with their attacker or need to consider transferring. Victims should not be in a position where they need to up-end their lives, their social network and source of support when they need it most, especially after a sexual assault.

I hope you will consider co-sponsoring this legislation.

Introduced as SB530
