Subject: | Aggravated Assault – Government Officials (Re-Introduction) |
In the near future, I will be re-introducing legislation – former House Bill 628 – that amends the Crimes Code regarding aggravated assault. More specifically, current law defines assaults on various officers and employees as aggravated assault. From time to time, the General Assembly expands that listing to include more individuals acting in an official capacity. My legislation would simplify the definition of officers and employees by including language that encompasses any government official or employee acting in his or her official capacity. The current language differentiates between various officials and employees. It makes one set of officials or employees assaulted on the job more important than others. In my opinion, any government official attacked while acting in or because of the scope of his or her employment or service should rise to the level of aggravated assault. Furthermore, by making this encompassing change, the General Assembly would have no need to further add to the list in the current definition.
