Subject: Covered Drugs and Drug Paraphernalia Disposal Pilot Program
 
In the near future, I will introduce legislation that will establish the Disposal of Covered Drugs and Drug Paraphernalia Act. Under my proposal, hospitals located in a city of the first class will be required to operate a covered drugs and drug paraphernalia disposal pilot program. Each participating hospital must submit a program plan that includes a description of a proposed covered drug and drug paraphernalia collection system, and a detailed description of the procedures a hospital employee must follow when collecting, transporting and disposing of covered drugs and drug paraphernalia. All participating hospitals will be required to have at least one collection site on campus.

My legislation will require hospitals participating in the pilot program to place a receptacle outside of their building, at their own expense, for the anonymous and safe disposal of covered drugs and drug paraphernalia. The receptacle must be bolted to the ground and be constructed to ensure that covered drugs or drug paraphernalia inside the receptacle are not retrievable by an unauthorized individual. The receptacle must also be within the view of at least one security camera.

All hospitals operating a program will be required to submit an annual report to the Department of Health detailing the program’s activities for the previous year. The Department of Health will assist in marketing the program by establishing a toll-free telephone number and publicly accessible Internet website for obtaining information about the program. At each hospital’s request, the Department of Health will also produce printed brochures and posters describing where and how to return covered drugs and drug paraphernalia at no cost. If a hospital fails to operate a program under this proposal, they will be subjected to a written warning from the Department of Health and an inspection for non-compliance within 30 days.
