Committee | JUDICIARY | Date | April 20, 2010 |
Bill/Resolution | HB190 PN0189 A06317 | Type of Motion | Adopt Amendment |
Maker of Motion | Rep. Marsico | Seconded by | Rep. Harper |
Brief Description |
The amendment deletes a reference to the 2008 Right-to-Know Law since that act currently exempts autopsy records, photos, and videos from public access. However, the RTK Law conflicts with a provision of the Coroner's Act which requires that the coroner deposit all "official records and papers" for the preceding year in the office of the prothonotary for the inspection of all persons interested therein. To the extenet autopsy audiovisual material may be considered part of the the "official records and papers" of the coroner, it is the intent of the legislation to prevent public inspection of such material. Accordingly, the amendment provides that autopsy audiovisual material shall not be deemed "official records and papers" of the coroner to be deposited with the prothonotary.
