The amendment requires courts to evaluate repeat drug and alcohol DUI offenders for the suitability of a substance monitoring program. A substance monitoring program would be a condition of bail that prohibits the individual from using controlled substances or consuming alcohol for 90 days in addition to being required to use drug or alcohol monitoring technologies.
