Subject: Protecting Kids from AI Exploitation
 
Recent cases involving the use of AI image generators to produce “deepfake” content involving children engaging in sexual acts is something we must take strong action to prevent. Let’s act to modernize our laws to prevent generative AI from producing child sexual abuse material or producing non-consensual intimate imagery of real individuals. My proposed legislation seeks to modernize our child pornography laws to account for AI-generated or “deepfake” depictions of child pornography.
 
This legislation accomplishes two things. First, it provides definitions for “artificial intelligence” and “artificially generated child sexual abuse material.” This will enable existing law to reach AI generated content. Second, this bill establishes civil liability both for those that use AI to generate this perverse content, and the companies that develop the programs that make it possible. Providing victims civil recourse offers them an additional path to pursue justice and ensures all responsible parties are held accountable for the dissemination of illegal content.
