MEMORANDUM

Subject: Liability Protections for School Entities and Child-Care Facilities

In the near future, I will be introducing legislation offering certain liability protections for school and child-care entities.

It has been no secret that during the COVID-19 pandemic our lives have been changed forever.  While our lives have been undoubtedly altered, there are those among us involved in professions which provide so much to our society that have been forced to adapt to the changing landscape while still being expected to deliver the services we have been accustomed to in the past.

One of these sectors is our schools and our childcare entities.  The vastly important task of educating and caring for our children is an essential societal function, and the expectation that these tasks can be performed in this new normal should not undermine the reality of everything that they now have to deal with.

Recently, we passed legislation offering certain immunity for a wide variety of professions in regard to COVID-19, and while that legislation was ultimately unsuccessful, I still believe we must do more to ensure that those performing these essential services can receive the comfort of knowing that they can do all that they can to navigate these challenging times without the fear of lawsuits.

This legislation will mirror language contained in former House Bill 1737 in terms of offering certain protections for school entities and child-care entities.  It is my hope that we can show that we are serious about our commitment to schools and others who care for our children by continuing to allow them to provide the much-needed services to our children and our communities in this changing environment by passing this narrowly crafted legislation.

I hope that you will join me as a co-sponsor to begin the process of getting this legislation enacted as soon as possible. If you have any questions please call David Kozak from my office at 717-787-3110.
