Subject: | Aggravated Assault By A Person In Custody |
Please join me in co-sponsoring legislation that would amend Title 18 to provide for the offense of aggravated assault by a person in custody. A person who is in the custody of the police or other law enforcement agency commits a felony of the third degree if he, while in custody, intentionally or knowingly causes or attempts to cause another to come into contact with blood, seminal fluid, saliva urine or feces by throwing, tossing, spitting or expelling such fluid or material. This legislation was cosponsored last session by Senators Ward, Rafferty, Sabatina, Brewster, Reschenthaler, Vulakovich, Costa, Boscola and Brown as Senate Bill 357. |
