Subject: Increased Penalties - Solid Waste Violations
 
I will be re-introducing legislation, SB 455, to amend the Solid Waste Management Act to increase the fine for violating hazardous waste storage requirements from $2,500 per violation to $7,500 per violation. The legislation also increases the fine for illegally transporting, treating, storing, or disposing of solid waste from $10,000 to $20,000 if such violation caused pollution, public nuisance, or bodily injury.

This legislation also assigns penalties according to the amount of toxic waste improperly processed or disposed of. A violator who processes or disposes less than 500 cubic yards of toxic waste would be guilty of a first degree misdemeanor and would be sentenced to pay a fine of not less than $2,500 and not more than $25,000 per day for each violation and up to 5 years in prison. If the amount of illegally processed or disposed toxic waste exceeds 500 cubic yards, the violator would face a third degree felony charge and would be sentenced to pay a fine of not less than $5,000 and not more than $50,000 per violation and a term of imprisonment up to 7 years.
