|I will be re-introducing legislation, SB 463, providing for a memorandum of understanding between the Commonwealth of PA and the US Department of Justice or Department of Homeland Security.
This legislation will authorize the Pennsylvania State Police to negotiate the terms of the memorandum of understanding concerning the enforcement of Federal immigration and custom laws, detention, removals, and investigations in the Commonwealth. This legislation permits the Pennsylvania State Police to designate officers to be trained pursuant to the memorandum of understanding only after the receipt of funding has been received from the Department of Homeland Security Appropriations Act, 2006 or any other source of Federal funding.
This legislation permits the District Attorney of each county to designate law enforcement officers to be trained in the memorandum of understanding. In counties of the first class, the district attorney may designate up to 4 law enforcement officers to be trained pursuant to the memorandum of understanding. In counties of the 2nd, 2A and 3rd class, the DA may designate no more than 3 law enforcement officers for this task and in all other counties, the DA may designate 1 law enforcement officer to be trained pursuant to the memorandum of understanding. The law enforcement officer certified and trained shall be authorized to enforce Federal immigration and custom laws.
