Subject: | Protecting Adults in Care Facilities |
In the near future, I plan to reintroduce SB 434 of last session. This legislation will help keep older adults who reside in care facilities/nursing homes safe from predators. This legislation is in direct response to numerous physical and sexual assaults on vulnerable older adults residing in care facilities that have taken place in southwestern Pennsylvania. These attacks were carried out by fellow residents who are predators and would have been found out if a simple check of their name had been conducted. Facilities who house older adults shall perform a simple search an applicant’s name on the Pennsylvania State Police registry of offenders and sexually violent predators, prior to admission into their facility. If the applicant resides or has resided outside of Pennsylvania, the facility will search the Dru Sjodin National Sex Offender Public website. In no case may a facility admit an applicant if their name appears on either the PSP or Dru Sjodin list of offenders. Also, within 30 days of the effective date of this legislation, facilities shall search current residents’ names. No administrator or facility shall be held civilly liable for any action directly related to good faith compliance with this chapter. |
