Subject: | Freedom of Association and the selection of Fair Share by public employees |
In the near future, I plan to introduce legislation which would eliminate restrictions on a public employee’s exercise of his or her right to freedom of association. Pennsylvania’s Public Employee Relations Act makes it lawful for public employees to engage in collective bargaining activities. The law also states employees may refrain from all such activities, but maintenance of membership provisions in collective bargaining agreements greatly restrict an employee’s ability to resign union membership to the final 15 days of a contract. In other words, a public employee may be forced to pay full union dues for years, even after they have decided to become a fair share fee payer. In many cases, this means funding a union’s political agenda they do not support. Public employees deserve the right to resign their union membership at any time during their contract.
