Subject: Reintroduction of Uniform Planned Community Act (UPCA) Transparency (Previously SB 1302)
 
Shortly, I plan to reintroduce my Senate Bill 1302, an amendment to the Uniform Planned Community Act (UPCA) to create more transparency for Homeowner’s Associations (HOAs) in the Commonwealth.

SB 1302 unanimously passed the Senate Urban Affairs & Housing committee with amendments and the full Senate last Session. Previous cosponsors were Senators Folmer, Scarnati, Dinniman, and McIlhinney.

HOAs are important entities that provide for the maintenance of shared space within a community, settle disputes among neighbors, and establish rules to protect property values. HOA agreements require a balance between individual liberty and community harmony. I would like to strengthen that balance through enhanced transparency and clarity over current law.

My proposed legislation would expand voting rights of HOA members by giving them more voting opportunities by increasing participation through:
  • Paper Ballots
  • Absentee Ballots
  • Electronic Ballots
  • Internet-based Ballots
