Subject: | Amending the Definition of Employer in the Pennsylvania Human Relations Act |
Please join me in co-sponsoring legislation introduced as Senate Bill 475 in the 2013-2014 legislative session. The bill was co-sponsored by Senators Teplitz, Kitchen, Stack, Browne, Fontana, Brewster, Washington, Williams, Ferlo, Hughes, Blake, Tartaglione, Farnese, Boscola, Schwank, and McIlhinney. In 2009, the Pennsylvania Supreme Court ruled there is no cause of action for sexual discrimination or sexual harassment under the Pennsylvania Human Relations Act (PHRA) for employees of small employers, which is defined as an employer with less than four employees. In order to ensure the rights of all employees, my legislation amends the definition of “employer” under the PHRA to lower the number of employees from four to one.
