Subject: | Unlawful Taking of a Tenants Rent Rebate |
Please join me in sponsoring legislation introduced as Senate Bill 389 in the 2013-2014 legislative session. The bill was co-sponsored by Senators Browne, Stack, Ferlo, Fontana, Kasunic, Brewster, Washington, Solobay, Waugh, Tartaglione, Hughes, Farnese, and Boscola. The legislation will make it unlawful for a landlord and tenant to enter into any agreement that requires a tenant to pay or assign to the landlord any part of a rent rebate to which the tenant is entitled under the Taxpayer Relief Act of 2006. The Attorney General’s Office is granted the authority to enforce this act. Further, any landlord who violates the act will be required to fully reimburse the tenant any portion of payment along with penalties and interest on the total amount of the payment to which the tenant was entitled.
