In the near future, I plan to reintroduce SB 821 of last session that will help keep older adults who reside in a living facility safe from predators. Facilities for older adults will search an applicant’s name on the Pennsylvania State Police registry of offenders and sexually violent predators, prior to admission. If the applicant resided outside of the state, the facility will search the Dru Sjodin National Sex Offender Public Website. In no case may a facility admit an applicant if their name appears on either the PSP or Dru Sjodin list of offenders. Also, within 30 days of the effective date, the facility shall search current residents’ names. No administrator or facility shall be held civilly liable for any action directly related to good faith compliance with this chapter. This proposed legislation is in direct response to numerous physical and sexual assaults on older adults residing in SW PA facilities. These attacks were carried out by fellow residents who are predators and would have been found out if a simple check of their name had been done. |
