Subject: Pennsylvania Fair Dealership Law (Corrected Version)
In the near future I plan on re-introducing legislation that amends Act 86 of 1987, known as the Pennsylvania Fair Dealership Law.

Similar legislation was first introduced by Senator Waugh in the 2009-2010 Legislative Session. It updates the statute to better balance the relationship between local dealers and both manufacturers and suppliers. It ensures that local dealers are fairly compensated for diagnostic time spent on repairs and recalls; prevents manufacturers from unduly using their influence to prevent a local dealer from purchasing the equipment of a competitive manufacturer or supplier; improves the protections afforded a local dealer from a manufacturer cancelling or terminating a franchise without good cause; and eliminates the requirement that local dealers waive their right to a jury trial and use arbitration to resolve disputes between the manufacturer and the local dealer.

This legislation was introduced as SB 1169 in the 2011-12 legislative session. There is language in that bill that exempts dealers that sell construction equipment. Those dealers have never been covered by the protections provided in the Fair Dealership Law, nor did they seek those protections.
