Senate of Pennsylvania
Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: January 31, 2013 12:52 PM
From: Senator Lisa M. Boscola
To: All Senate members
Subject: BOSCOLA- Insurance coverage for infertility treatments

In the near future, I plan to reintroduce legislation amending The Insurance Company Law of 1921 by adding language that will provide for the coverage of infertility treatments and medication.

Many couples across Pennsylvania and the nation want nothing more than to conceive a child and start a family. Unfortunately, for some couples, this is not possible without the use of costly infertility treatments that are not always covered by health insurance policies. My legislation would require all health insurance policies that provide pregnancy-related benefits within the Commonwealth to also provide coverage for the diagnosis and treatment of infertility.

Infertility drugs are also very costly, but are often used to increase the success of infertility treatment. Therefore, my legislation would prohibit insurance companies from imposing any exclusions, limitations, or other restrictions on coverage of infertility drugs that are different from those imposed on any other prescription drugs.

Currently, several states require insurance companies to offer this coverage, including but not limited to Massachusetts, New Jersey and Illinois. It is my hope that this legislation will allow those couples that want to start a family to do so without the worry of oftentimes burdensome cost of infertility treatments.

This is a reintroduction of SB 193 from the previous legislative session. Co-sponsors included: WILLIAMS, TARTAGLIONE, LEACH, BREWSTER,FONTANA AND RAFFERTY

Introduced as SB767
