MEMORANDUM

Posted: December 19, 2012 03:26 PM
From: Senator LeAnna M. Washington
To: All Senate members
Subject: Limits on firearms purchases by mentally ill individuals

In the near future, I plan on reintroducing a package of bills that aim to prohibit handgun purchases by the mentally ill in the Commonwealth. This legislation is similar to SB 1038 of the 2007-2008 legislative session and SB 26 from 2009-2010 session.

Previous co-sponsors were: FONTANA , GREENLEAF, KITCHEN, WILLIAMS, STACK and LEACH

Please contact my office with any questions you may have.

Document #1

Introduced as SB189

Description: The first bill would provide for limiting access to firearms by mentally ill persons who have been ordered to undergo involuntary mental health treatment on an outpatient basis. The aim of this legislation is to limit harm to others as well as prevent an individual from causing serious bodily harm to themselves.

Document #2

Introduced as SB190

Description: The second bill would make changes to the confidentiality laws which will allow for these individuals to be placed in the National Instant Criminal Background System, maintained by the FBI.
