MEMORANDUM

Posted: June 20, 2023 03:41 PM
From: Representative Elizabeth Fiedler and Rep. Mary Jo Daley, Rep. Greg Scott, Rep. Steve Samuelson, Rep. Sara Innamorato, Rep. Rick Krajewski, Rep. David M. Delloso, Rep. Napoleon J. Nelson
To: All House members
Subject: Combined Reporting

Supporting local businesses benefits workers, business owners, and the communities we represent.

Right now, Pennsylvania businesses pay the Corporate Net Income Tax rate on all their income, while multi-state corporations can shield much, and in some cases all, of their income from the CNIT. They pay less than their fair share of the Corporate Net Income Tax while relying on the services provided by the state. And when multi-state corporations pay less than their fair share, a greater tax burden is placed on Pennsylvania-based businesses and individual taxpayers.

Our legislation will require multi-state corporations to use combined reporting to determine their tax responsibilities: they will pay the CNIT based on the share of their U.S. income that is equal to the share of their U.S. sales in Pennsylvania. This policy is already used by 28 states and the District of Columbia.

This change will benefit small and local businesses in our state. Please join me in co-sponsoring this important legislation to support PA workers and businesses.

Introduced as HB1462
