Subject: Enforcement of Failure to Stop for School Bus with Flashing Red Lights
 
As we continue to move into the future with automated enforcement programs across our state, we must also ensure that we are remaining consistent and streamlined.
 
Under current law, the School Bus Stop Arm Camera Program in Title 75 (Vehicles) is over burdening the Magisterial District Judge (MDJ) court system. Persons issued citations under this law are contesting a citation before the MDJ rather than an administrative hearing officer, as is done with both the Automated Work Zone Speed Cameras and Automated Red-Light Enforcement.
 
Our legislation would fix this burdensome glitch and provide an avenue for timely due process for individuals seeking to contest a School Bus Stop Arm Camera violation. Individuals will be able to contest the violation before an administrative hearing officer first, and then the local MDJ if they would like to contest the ruling of the administrative hearing officer.
