Subject: Holding Bad Law Enforcement Actors Accountable
 
I will be proposing legislation that amends our criminal statutes to protect against overzealous law enforcement engaging in conspiracies to entrap citizens of Pennsylvania in criminal activity.  
 
There is already an "entrapment" defense to a criminal prosecution by proving that law enforcement unlawfully induces or encourage a person to engage in criminal activity.  But this reprehensible conduct comes without criminal consequences to the law enforcement officers who ignore their sworn duties to the law.  Just as it would be criminal for a private citizen, for example, to concoct a kidnapping plan and conspire with others in furtherance of that plan, so too should a law enforcement officer who creates a conspiracy for the purpose of inducing otherwise law-abiding citizens into criminal activities they would not otherwise have engaged in.   My bill will provide that the same elements of the current entrapment defense would be a criminal offense by the law enforcement officer who does the entrapment.
