Subject: Streamlining PennDOT and Turnpike Construction Contracts
 
I am introducing legislation amending the state Procurement Code permitting the Department of Transportation to use the Design Build- Best Value Procurement (DBBV) method in some instances.

Pennsylvania procurement law and case law requires that all contract construction work performed for PennDOT and the PA Turnpike Commission must be contracted solely through the current procurement method.  In certain instances, it is desirable for both the Commonwealth and the design and construction industry to combine procurement into what is known as “Design Build- Best Value Procurement (DBBV)”.

Design Build- Best Value Procurement (DBBV) allows certain qualifications to be considered when selecting a design and construction team to jointly complete a construction project.  The proposed legislation would--under limited circumstances—allow PennDOT and the Turnpike Commission to procure construction under this method of procurement, rather than through the current procurement system.

Some benefits of Design Build Best Value Procurement
  • Overall project timeline can decrease resulting in faster project completion.
  • Concurrent activities may be streamlined, resulting in cost effective projects.
  • More collaboration between design and construction is achieved.
  • Effective for Complex Projects, allowing for private sector innovation.
  • Less demand on PennDOT and Turnpike Commission engineering and project oversight resources.
  • Risk sharing is greater between owner and contractor.
  • Fewer work orders occur due to the collaborative nature of the system and often Design-Build projects have reduced claims and claims litigation.
Passage of this legislation will give the Commonwealth another procurement method under limited usage that may be advantageous to the taxpayer and that is used in many states around the country.
