Subject: Appeal Process for Signage Placing Along Right-of-Way
 
It is my intention to introduce legislation that would establish an appeals process when denied permission by PennDOT to place a sign, banner, or piece of advertising along a highway.
 
In Pennsylvania, it is unlawful for anyone to place a sign, banner, or piece of advertising along a highway without the written consent of PennDOT. Any person who violates this section of the law is subject to a summary conviction and sentenced to pay a fine of anywhere from $4 to $20.
 
Unfortunately, under current law, there is no process to appeal the denial of signage placing along a highway.
 
I believe this legislation will give individuals the opportunity for an appeal an unnecessary conviction by creating a fair appeals process to minimize disruption of businesses.
