Subject: | COSPONSOR MEMO - Settlements Received by Commonwealth Agencies – Ensuring money received is subject to oversight |
Colleagues – In recent years, various state agencies have received significant funds from settlements, litigation, or enforcement actions. Some of these settlements reach into the tens of millions of dollars. Under existing law, such funds can be used at the agency’s discretion with authorization from the Secretary of the Budget. The General Assembly has no oversight of these funds in such instances. My legislation would require money received by a state agency from a settlement, litigation or an enforcement action be deposited to a segregated account in the General Fund. Funds in excess of the costs associated with the litigation would require appropriation by the General Assembly. This would ensure these funds receive the same amount of attention and oversight in the annual budget process as other money in the State Treasury.
