| Subject: | Improving the Permit Decision Guarantee Program at the Department of Environmental Protection |
| In 2012, the Department of Environmental Protection (DEP) established the Permit Decision Guarantee policy to govern the permit review process. This policy was intended to establish clear guidance and a predictable processing timeline for review and approval of permits. I will soon be introducing legislation to improve and build upon that departmental policy. This legislation would allow permit applicants who pay an additional fee to receive expedited permit review. Funding from the expedited review fee would be used to fund information technology upgrades to improve the overall permit review system. As a departmental policy, the current Permit Decision Guarantee does not have the force of law and is subject to changes by DEP without notice or public input. This legislation would provide statutory backing for the Permit Decision Guarantee, while making important adjustments to ensure that the system works as intended.
