Subject: | Closing the Out of State Brewing Loophole |
My legislation will propose to amend the Liquor Code to clarify malt or brewed beverages produced for a brewery by a manufacturer out-of-state, must be distributed through the three-tier system. Section 431(b) of the Liquor Code specifically requires any products produced out-of-state be distributed through the three-tier system. This amendment will close the current loophole existing in law, which permits breweries to skirt the law, and sell products manufactured out-of-state directly to consumers. My legislation should have no negative impact to Pennsylvania jobs, as this simply ensures malt or brewed beverages produced out-of-state are distributed through the three-tier system, since those products are not produced by a Pennsylvania manufacturer. In fact, any potential impact to jobs should be positive, as closing this loophole will ensure manufactures who choose to contract brew and self-distribute will do so with in-state brewers. Please join me in co-sponsoring this important legislation that will protect our successful three-tier system and put an end to this out-of-state contract brewing loophole. |
