House of Representatives
Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: April 19, 2021 02:11 PM
From: Representative David H. Rowe
To: All House members
Subject: Legal Workforce Act

In today’s age of rapid information and background checks it is still far too easy for illegal aliens to find employment within the Commonwealth. The common law-abiding man must provide his work, criminal, and citizenship history to get an honest job, but illegal aliens can procure the same jobs with faked paperwork and a look the other way. This is not fair to the people of Pennsylvania, it corrupts our tax base, and enables criminals to find employment and opportunity at the expense of our constituents.

The Legal Workforce Act will achieve the following:

  • Make E-Verify utilization mandatory for businesses operating within the Commonwealth so as to affirm the citizenship of their employees.
  • Enable anonymous complaints to be filed to allege violations of this Act by an employee against their employer, with substantiated complaints resulting in enforcement actions against the employer.
  • Employers that are found to be violating this act would receive an immediate suspension of all licenses, must terminate the employment of all unauthorized aliens, and file an affidavit assuring compliance with the Act is taken. - Further violations result in increased suspensions and punishments.
  • All compliance will hinge on the determination of immigration status before employment via the Federal Government’s determinations and the utilization of E-Verify.
  • All payments found to be made to unauthorized aliens shall not be deductible for tax purposes.

For these reasons I ask that you join me in co-sponsoring the Legal Workforce Act.
