|Subject:||Planned Communities Tax Equity Legislation|
|I plan to introduce legislation which will address a disparity in the level of taxation of certain Pennsylvanians who live in planned communities, commonly known as homeowners’ associations or condominiums. In a number of these planned communities, homeowners are required to pay annual fees and assessments for the upkeep and maintenance of commonly owned facilities and services infrastructure such as streets, water and sewer facilities, trash removal and the like. At the same time these homeowners are paying municipal taxes for similar facilities and services that other homeowners living in the same municipality but not in a planned community receive.
My intention is for equity and fairness. Homeowners living in planned communities should, through their homeowners’ association, be able to negotiate with the municipality to supply the service or reimburse the homeowners for the actual costs incurred by these homeowners for the services.
If the homeowners’ association and the municipality are unable to negotiate an agreement, then the two sides shall enter into arbitration.
