Subject: Abortion Clinic Reports - Former HB 2138
 
In the near future, I plan to re-introduce legislation (HB 2138) amending the Health Care Facilities Act requiring an abortion facility to post their inspection results, as well as their plan of correction, on their website. These results must be posted within 30 days of receipt of the written notice or sooner if directed by the Department of Health.

My legislation would also require the abortion facility to update their website, as necessary, to reflect the results of an inspection or changes to their plan of correction. Furthermore, if an individual requests a copy of the inspection, the facility must provide a copy at no cost to the requestor.

Current law requires abortion facilities to be inspected by the Department of Health on an annual basis with at least one unannounced inspection. When an abortion facility is inspected, the privacy of each patient must be respected. Currently, abortion facilities are not required to comply with posting their inspections, and plan of corrections, on their website. Nor are these facilities required to provide this documentation free of charge to anyone that requests this information.
