Subject: Employment Protections for Members of National Guards
 
In the near future, I will be proposing legislation to extend current employment protections to Pennsylvania citizens who are members of another state's National Guard. Current law under Title 51 (Military Affairs), provides employment rights protection to citizens of this state who are members of the PA National Guard.

Many states are strengthening their statues to protect the reemployment rights of members of the National Guard. Just over half of the states have language sufficient to provide enforceable reemployment rights.

In addition, the federal Uniformed Services Employment and Reemployment Rights Act (USERRA) does not apply when a National Guard member is called-up, by their Governor, to serve state active duty in order to respond to state emergencies such as fires, hurricanes, tornadoes and flooding. This is especially true for our citizens who are members of another state's National Guard.
