MEMORANDUM

Posted: April 21, 2020 01:59 PM
From: Representative Russ Diamond
To: All House members
Subject: Amending the Emergency Services Management Code

I will soon be introducing legislation to flip the switch on extending disaster emergency declarations for future governors. Under this legislation, if a governor wants a disaster emergency to extend beyond 45 days, he will need explicit approval from the General Assembly via a concurrent resolution. Currently, a disaster emergency can last up to 90 days, but the governor can unilaterally extend and renew it.

My bill will make a simple language change to Title 35, Section 7301(c) and is the first step in reclaiming our authority during disaster emergencies. Please join me by cosponsoring this important legislation.

Introduced as HB2428
