Subject: | Covid-19 -- Electronic Notarization of Documents |
Please join me in co-sponsoring legislation that would assist our banks, credit unions and other financial institutions in this time of crisis. This legislation amends Title 57 (Notaries) to authorize the electronic notarization of documents where the signer appears before the notary by means of real-time audio-video communication. If enacted, this legislation would assist in making things easier in this time when social distancing is the norm and many cannot go out to sign documents in person. Under this legislation, a notary could perform acknowledgements, administer an oath or affirmation, take a verification on oath or affirmation, witness or attest electronic signatures and certify or attest a copy by means of a real-time, two-way audio-video communication. These acts could only be performed using technology that allows individuals to communicate by simultaneously seeing and speaking to one another. This legislation does not, in any way, replace notaries or change the services they provide. Rather, it authorizes a way of doing business when individuals cannot be physically present.
