MEMORANDUM

Posted: March 3, 2020 10:01 AM
From: Representative Louis C. Schmitt, Jr.
To: All House members
Subject: Liquid Fuels Tax Municipal Allocation Law

In the near future, I plan to introduce legislation amending Title 53 (Municipalities) clarifying municipalities do not need to bid traffic signal maintenance and repair contracts when using Liquid Fuels funds.

Prior to October 2018, municipalities commonly contracted traffic signal maintenance and repair services by professional services contracts. Under the municipal codes, professional services contracts are not subject to the bidding requirements. However, many Liquid Fuels audits were flagged by the Auditor General for not complying with bidding and contracting requirements.

My legislation would simply clarify that the previous practice in Title 53 is allowable when using Liquid Fuels funds. This simple clarification will help municipalities save limited transportation dollars.

Please join me in co-sponsoring this legislation.
