Subject: | Protecting Consumers by Requiring Retailers to Clearly Post Return Policies |
In the near future, I will introduce legislation that will increase consumer protections by requiring retailers to issue a refund to consumers unless the retailer’s refund policy is conspicuously displayed. This legislation is in response to a situation where a constituent purchased an article of clothing that turned out to be the wrong size and attempted to return the item; however, the retailer refused to issue a refund. Although the retailer had a return policy that stated they do not accept returns, the policy was not readily visible, and the constituent was unaware that it existed when the purchase was made. Specifically, this bill will add a definition to the “unfair or deceptive acts or practices” list in the Unfair Trade Practices and Consumer Protection Law to prohibit retailers from refusing a refund unless a refund policy was explained or conspicuously posted in the establishment or at the point of sale. By requiring retailers to conspicuously post their return policy or else be required to issue a refund, this legislation will help ensure that buyers and sellers can conduct voluntary transactions in a manner that is more informed and transparent.
