MEMORANDUM

Posted: February 4, 2019 10:18 AM
From: Representative Anthony M. DeLuca
To: All House members
Subject: Establishing the Office of Consumer Advocate for Health Insurance

As insurance companies become more concerned with utilization in order to keep premiums from skyrocketing, Pennsylvanians may find themselves fighting to access their benefits. And, as health insurance becomes more expensive, getting the full benefit of one’s health insurance is ever more important. For these reasons, and more, I believe it is time we create the Office of Consumer Advocate for Health Insurance.

The Consumer Advocate for Health Insurance will be housed in the office of the Attorney General and appointed by the Attorney General. The advocate will serve a six-year term with a two-term term limit. Additionally, the salary for this position will be set by the Executive Board.

Once an appointment is made, the Consumer Advocate for Health Insurance will have the following duties:
  1. Represent the interests of consumers before the Insurance Department, and any court or agency,
  2. Determine when it is appropriate to initiate proceedings ,
  3. Bring any action before a court or agency in the name of the Consumer Advocate for Health Insurance,
  4. Issue written statements clearly stating the specific interest of consumers to be protected.
Pennsylvanians deserve to have someone who is in their corner when it comes to health insurance matters. Help me make this a reality by co-sponsoring this legislation today.
