Consumers in Pennsylvania have a right to access the Internet without fear of having their personal information compromised. News of significant data breaches have increased over the past few years, bringing attention to the vulnerability of personal data and the importance of its safe disposal. We must make every effort to protect this data from falling into the wrong hands. Protecting the release of this information without the express consent of the consumer is paramount. To obtain this goal, I am forwarding a package of two bills to protect Pennsylvanians. As responsible public servants, Proposal # 1: Internet Privacy and Consumer Protection - Augments our efforts to protect telecommunications and Internet customers by prohibiting the disclosure of personal information by Internet Service Providers (ISPs), except in certain specific instances. It further prohibits the use of false or misleading messages by commercial entities and provides a toll-free number for consumers to opt-out of such messages. Proposal # 2: Personal Information Safety and Disposal - Requires timely notification of data breaches to consumers and the Office of Attorney General; assures privacy agreements are written in plain, easy-to-understand language; and mandates procedures for the safe disposal of materials containing personal information. We must commit to expanding the safety of consumers personal data as technology advances.
