|Subject:||Preemption of Local Labor Mandates|
|During the history of the Commonwealth of Pennsylvania, labor policy has been adopted at the state level to ensure uniform workplace policies and a predictable economic policy across the state. This is common within the state as local government cannot set their own labor policies regarding minimum wage and prevailing wage. In recent years local governments, sometimes in violation of state law, have been adopting local ordinances on labor policy.
Local ordinances like these are problematic for our economy as they ignore the simple fact not all businesses are the same. Additionally, these local mandates create an uneven playing field for the businesses located inside Pennsylvania while raising the cost of compliance inside the municipality. These cost increases further hurts businesses operating separate locations inside and outside the municipality as they comply with separate policies on the same topic.
In order to address this problem, I plan to reintroduce House Bill 861 as passed by the House Labor and Industry Committee last session. This bill would preempt local governments from passing labor policies while addressing the concerns raised during public hearings last session. Local mandates on private business not only increase cost, but they create an unequal foundation for Pennsylvania’s economy. This negatively impacts our economy and state revenue as labor policies set by local governments have an impact which extend beyond the specific municipality.
