MEMORANDUM

Posted: January 3, 2019 02:37 PM
From: Representative Angel Cruz
To: All House members
Subject: Penalties for Murdering an Unborn Child

When a pregnant woman is killed, two lives are taken. Our current criminal laws do not reflect the severity of this crime.

Such careless disregard for human life should not be treated lightly, so I am proposing a bill to strengthen penalties for the murder of an unborn child. Under my bill, a person who commits murder of a pregnant woman in the first degree and therefore causes the death of her unborn child will also face first degree charges for the murder of the child. Additionally, in cases where a person commits murder in the second or third degree, or commits voluntary manslaughter of a pregnant woman, they will also face the corresponding charge for the murder of her unborn child. My bill specifies that these charges are applicable whether or not the perpetrator had prior knowledge of their victim’s pregnancy.

I hope you will join me in making a simple but very important change to our law. Thank you in advance for your consideration.

If you have any questions or concerns, please contact my Harrisburg office at 717-705-1925.

Introduced as HB203
