Subject: Amend Borough Code, First Class Township Code and Third Class City Code/Storm Water Fee
 
I plan to introduce legislation that amends the Borough Code, First Class Township Code and Third Class City Code to authorize them to assess fees for storm water management activities and facilities without the need to establish a municipal authority. The Borough Code legislation was passed last session as HB 1394 but it did not receive action in the Senate. We did give this authority to Second Class Townships last session by amending the Second Class Township Code via Act 62 of 2016.

Currently, if a borough, first class township or third class city needs to implement a storm water fee to comply with EPA directives and regulations, it must create a separate municipal authority in order to assess the fee. This defies common sense and simply creates another unnecessary layer of government directed by unelected officials. My legislation holds those who implement the fee accountable to those who will be required to pay it. If the public is not happy with the decision to impose a storm water fee, it can voice its opinion at the ballot box.
