MEMORANDUM

Posted: January 10, 2017 09:50 AM
From: Representative Thomas P. Murt
To: All House members
Subject: Defining Ophthalmic Surgery (Prior HB 1305)

I plan to reintroduce legislation to amend the Medical Practice Act of 1985 to provide a definition of ophthalmic surgery.

The Medical Practice Act of 1985 does not currently provide a definition of surgery performed on the eye and/or eyelid, and while the Optometric Practice and Licensure Act prohibits optometrists from performing surgery, it also does not define that term.

Pennsylvania law is clear, only a physician is authorized to perform eye surgery; what is not clear is what exactly eye surgery is. The definition in my legislation was developed by ophthalmic surgeons and will clarify those procedures that only a physician may perform.
