Subject: Act 101 Population Density Requirements
 
As part of Act 101 of 1988, "The Municipal Waste Planning, Recycling and Waste Reduction Act," recycling is mandatory in municipalities with populations over 10,000 and those with populations between 5,000 and 10,000 that have population densities greater than 300 persons per square mile. At present, 440 of Pennsylvania's 2,700 municipalities are mandated to recycle and provide curbside collection programs.

In many rural municipalities with few developments and a low population density, it is impractical to implement mandatory recycling programs even though the total population of the municipality may be over 10,000.

In the near future I will be introducing legislation which rectifies this situation by adding a provision which mandates that only populations of 10,000 or more that have a population density greater than 500 people per square mile are required to implement a recycling program.

Please join me in ensuring that the recycling laws of the Commonwealth are as fair and effective as can be.
