Subject: Legislation to correct drafting errors in HB1429
 
In the near future, I will introduce language to address drafting errors contained in Act 95 of 2014. This statute represents an update to the power of attorney statute in Pennsylvania. It was passed by the House on June 19, 2013 by a vote of 198-0. The governor signed the bill, which I sponsored, on July 2, 2014.

As happens occasionally with complex legislation, errors in drafting were committed. Specifically, the requirements which apply to powers of attorney executed by individuals have not applied to corporations under Pennsylvania law. Act 95 of 2014 failed to carry this policy into the new law. My legislation fixes this error.

By way of background, a power of attorney is a legal document in which a person (principal) can appoint another (agent) to act on his behalf. The power to act for the principal may include the power to give away property, the power to acquire real estate, and the power to authorize medical treatment. A principal can appoint a family member, an attorney, or a bank to be an agent.
