Subject: Background Checks for School Bus Drivers
 
I am preparing to re-introduce legislation that will simplify criminal background check requirements for school bus drivers.

Under current law, all current and prospective employees of public and private school entities must submit with their employment application a criminal history report. A person who has provided this information once may transfer to or provide services to another school in the same school district, diocese or religious judicatory or established or supervised by the same organization without obtaining an additional report. However, a person who wishes to work for only one school entity but under the auspices of more than one employer must obtain multiple criminal history reports. This requirement can pose a specific challenge to a school bus driver, who may work both as an independent contractor and as an employee of one or more separate entities.

My legislation, which I introduced last session as HB 1061, will ease this burden on school bus drivers by providing that a bus driver who has once obtained the required criminal history report may provide services to the same school entity as an independent contractor or as an employee of an independent contractor, without obtaining multiple criminal history reports. As required under current law, the individual must still obtain a new background check each time he provides services to a new school entity, and must disclose any new arrests or convictions to his employer or face discipline up to and including termination or denial of employment and possible criminal prosecution for unsworn falsification to authorities.
