| Subject: | Amending the Scrap Material Theft Prevention Act of 2008 - Prior HB2038 |
| In the near future I plan to re-introduce legislation amending the Scrap Material Theft Prevention Act of 2008 to include second-hand dealers, such as used video game and electronics stores. This legislation was previously introduced as HB 2038 (2013-2014.) While pawn brokers, precious metals dealers and scrap metal processors are all currently required to collect identifying information from individuals selling used goods, retail outlets that offer a “buy back” service are not obligated to do so. The lack of a requirement to provide identifying information may incentivize the use of these services by individuals looking to sell stolen property. My legislation places identification requirements on second-hand dealers similar to those currently required of scrap metal processors and recycling centers. The legislation also provides for penalties and enforcement. By requiring identifying information as a condition of using a buy back service, second-hand dealers will be less likely to be used as a pipeline for stolen property. |
