Subject: Act 32 Clarification
 
In the near future I will be re-introducing former House Bill 2423 of the 2013-2014 Legislative Session. This legislation addresses the concerns of tax practitioners in regard to Act 32. Since inception in 2012 it has become apparent that some technical changes are required.
My legislation which is based on recommendations from practitioners includes the following:
  • Taxpayers with no income will not be required to file a local return.
  • Clear and concise safe harbor language for estimated taxes.
  • Provides for oversight of the local Tax Collection Committee.
  • Clarification of temporary job assignments (what tax rate should be withheld for en employee on a temporary assignment).
  • W2 Reporting requirements
  • Definition of a non-resident.
  • Audits of taxes received and disbursed on a calendar year basis only.
